2017 Asper Centre Constitutional Roundtable Series: Section 7 and the Idea of the Charter

Speaker: Jamie Cameron, Professor, Osgoode Hall Law School

In celebration of Canada’s Sesquicentennial, this series will provide an analysis of Constitutional litigation throughout Canada’s history with a focus on seminal cases that have made an impact on the Canadian constitutional rights landscape.

Section 7 and the Idea of the Charter looks at the concept of the Charter through a Section 7 lens. It treats Section 7 as a metaphor – as the metaphor – for the central methodological, interpretative, and institutional challenges of Charter decision-making. Section 7 exemplifies the most difficult questions the Supreme Court of Canada has had to consider and has generated the most provocative jurisprudence among the guarantees. Issues of a methodological, doctrinal, and theoretical nature are engaged by Section 7 in distinctive ways which nonetheless reflect back on and illustrate Charter themes of general application.
